Terms of Use. If you use this website to purchase products from Haas Automation Europe nv, having its registered office at Mercuriusstraat 28, 1930 Zaventem, Belgium, and with VAT n° BE 0473.193.219 (“Haas”), you agree that you understand and agree to be bound by the provisions herein (the “Terms and Conditions”). These Terms and Conditions apply to purchases from Haas via the website, and constitute an agreement between you and Haas, and are incorporated into any price quote, order, acknowledgment, invoice, or other communication you send to or receive from Haas. We reserve the right to change these Terms and Conditions from time to time for any reason and without separate notice of the change, it being understood that the version of the Terms and Conditions in force at the moment of an individual purchase will apply to the purchase concerned. Application of (purchase) orders you may have in place yourself is explicitly excluded.

Export control and sanctions regulations. By placing an order, the purchaser acknowledges and understands that the items purchased in this order are subject to the export control and sanctions regulations of the United States and the European Union, and that the purchaser will comply with all such regulations. The purchaser further confirms and acknowledges that, per Haas policy, the purchased items are not permitted to be exported outside of the European Union, and are solely for use by the purchaser.

Orders and Shipping. Once you place an order through this website, Haas will normally ship the order by the end of the following business day. If the order is received by 3:00 p.m. Brussels time on a business day, the product will normally ship that same day. Haas will use commercially reasonable efforts to meet the shipping schedule set forth herein, but does not guarantee that it will do so in all cases. In any event and unless expressly indicated otherwise by Haas, the delivery terms are indicative only, and you confirm that the delivery term does not constitute an essential element of your purchase. Except in case of gross negligence, fraud, or willful misconduct, Haas shall not be liable for (the consequences of) any delay. Haas reserves the right to carry out partial deliveries. Haas will at its sole discretion select the shipper to be used.

Haas is not bound by any order placed until the order is accepted by Haas. Haas may accept or refuse any order placed at its sole discretion, but will inform you of such acceptance or refusal.

The risk for loss of or damage to the goods shall pass to the customer at the moment of shipment of the goods.

Price and payment. Unless explicitly indicated otherwise, all prices are exclusive of transport costs, VAT, taxes, and other levies, which are always for the account of the customer.

Any amount that, for whatever reason (e.g., if a payment is returned or denied by the customer’s credit card company), is not paid by the customer on the contractual due date shall be increased with a late payment interest equal to 1% per month, and a fixed compensation equal to 10% of the amount due with a minimum of €250.

Despite our best efforts, we cannot exclude that a product listed on our website may exceptionally be listed at an incorrect price. In such case, Haas shall be entitled to cancel the purchase order, even after acceptance of such order.

Haas expressly reserves all rights for any products supplied until payment of the total price, payment of interest, and additional cost (if any). The rights of property shall not be deemed to pass to you until full payment has been made in accordance with the invoices supplied by Haas.

Returns and Refunds. If you wish to return your order to Haas, you must first obtain a Return Authorization; you may obtain a Return Authorization form through the website, or contact Customer Service at customersupport@haascnc.com, and have your order number or account information available. Returns will only be accepted within seven days (7) of delivery with a Return Authorization. Return items must be new, in the original packaging, and show no signs of wear, damage, abuse, or alteration. Failure to meet these conditions may cause denial of your return request and parts will not be shipped back to you. If we accept your return, we will refund your purchase price, less the cost of a) (re)shipping and b) a restocking fee equal to twenty percent (20%) of the purchase price. Some items may not be eligible for return; any such items will be listed on the website. Refunds will normally be given in the same form as the original payment, e.g., credit card, PayPal, etc. Haas is in no way whatsoever obliged to accept a return request, and shall decide at its own discretion whether it grants a Return Authorization.For all Return Authorization Requests of a Haas Tooling Kit (08-xxxx part number), all items included in the Kit MUST be returned to receive a refund/credit. If only a portion of the Kit is returned, no refund/credit will be issued. Returned items must be new, in the original packaging, and show no signs of wear, damage, abuse, or alteration. Failure to meet these conditions may result in the denial of your return request, and the returned parts will not be shipped back to you. 

Back Orders. If your order contains both in-stock and out-of-stock items, it will be shipped in multiple shipments. The in-stock items will be shipped in accordance with section “Orders and Shipping,” and out-of-stock items will be shipped as they become available. Any international orders containing out-of-stock items can be held until all items are available. We will make reasonable efforts to give you accurate estimates of the waiting time for out-of-stock items. You will be charged for your order of out-of-stock items at the time it is received by Haas, but you may cancel your order at any time before shipment, for a full refund.

Order Discrepancies. It is your responsibility to inspect all products on receipt to verify that they are consistent with your order, as to conformity, quantity, and quality. Complaints regarding order discrepancies must be reported in writing within seven (7) calendar days of receipt of the ordered products. You must keep such products available for inspection by Haas, and undertake all necessary and reasonable measures to avoid and limit any damage. The use or conversion of the products by you implies the irrevocable acceptance of the products.

Complaints regarding hidden lacks in conformity are only valid if they are communicated in writing to Haas within seven (7) calendar days after discovery of the flaw, and under the express condition that (i) such products remain available for the inspection by Haas and (ii) you undertake all necessary and reasonable measures to avoid and limit any damage.

Complaints regarding order discrepancies are to be sent by e-mail to customersupport@haascnc.com.

In any case, claims regarding non-conforming or defective products are subject to a limitation period of one (1) year from the delivery of the products.

You cannot invoke any complaint to delay or defer the payment of the price, not even partially, nor do you have the right to cancel the full order or delivery.

Deliveries. Depending on the method of shipment, we may require a signature on delivery. If you request delivery with no signature required, Haas cannot be held liable for any damage or loss for a package left without signature. If a delivery carrier that you choose fails to deliver your order on time, or loses an order, we will file a claim on your behalf, but will not be liable for the loss.

Proper Use. It is your responsibility to use all products in a responsible manner, consistent with their intended purpose, and with any instructions or manuals communicated by Haas or delivered together with the products. Haas will not be liable for any damage resulting from products used in an improper or dangerous manner; including, without limitation, products used beyond their normal lifespan; products that have been altered or tampered with; products that have been stored, transported, handled, installed, or used in a negligent manner or in a manner not compliant with the instructions; and products that have not been properly and regularly maintained.

Upon delivery, you are solely responsible for the proper installation, use, storage, and proper maintenance of the products. All costs arising from one of the aforementioned obligations are for the account of the customer only.

Standard Quality specifications and deviations. Haas only warrants that the products shall conform to the basic specifications for the products as communicated by Haas in technical or contractual documents, or as may be reasonably expected.

Insignificant or minor deviations as to color, composition, shape, design, weight, or the state shall not constitute or give rise to order discrepancies.

Any additional data sheets or other marketing-related documents sent by Haas to you relating to the products or its specifications, are deemed to be for informational purposes only, and do not entail any supplementary specifications or obligations in respect to Haas.

All recommendations or statements about the products by Haas, including anticipated performance of the products, are based on Haas’ experience and research, but shall not constitute in any way a warranty; and no employee, agent, or representative of Haas is authorized to give any such warranty. You must determine, by tests or otherwise, the suitability of the products for your own purposes yourself. In no case does Haas guarantee that the products are fit for the purpose anticipated by you.

Warranties. If any products on this website contain any defects in materials and workmanship, you may request a replacement in accordance with the procedure set forth in the article on “Order Discrepancies.” Haas will replace products that are defective in materials or workmanship, but only if any defects arise from normal usage and Proper Use. This warranty does not cover any product malfunctions or failures resulting from misuse, abuse, neglect, alteration, modification, or from repair by anyone other than Haas. EXCEPT AS SPECIFICALLY SET FORTH HEREIN, AND SUBJECT TO APPLICABLE LAW, HAAS DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ANY WARRANTY ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE.

Limitation of Liability. To the largest extent permitted by relevant laws, Haas cannot be held responsible or liable for intangible, indirect, or consequential damages, including (but not limited to) loss of profits, loss of revenue, loss of income, restrictions on production, administration or staff costs, an increase in general costs, loss of clientele, or claims of third parties.

In no event shall Haas’ liability exceed the purchase price of the products you purchase from Haas.

Your exclusive remedy for any order discrepancy or defective product shall be the replacement of the product concerned, without any additional compensation for damage allegedly incurred as a result of the order discrepancy or defect.

The limitations and exclusions set out in this paragraph, and elsewhere in these Terms and Conditions, shall not have the effect to limit or exclude any liability that may not be limited or excluded under the applicable law.

Accuracy of Website and Disclaimer. We make reasonable efforts to assure accuracy of all matters appearing on this website, but reserve the right to correct any errors that we discover, and to change or update information from time to time. YOUR USE OF THIS WEBSITE AND ITS CONTENT IS AT YOUR OWN RISK. Force Majeure. Force Majeure means the occurrence of events or matters which make performance of obligations impossible, impracticable, or unsafe, including without limitation an act of God; inevitable accident; fire; strike or other labor dispute; war or threat of war; act of public enemy; act of terrorism or threats thereof; act of civil commotion; national state of emergency; enactment, rule, order, or act of any government or governmental instrumentality; political instability; epidemic (including a health pandemic); interruption in or substantial delay or failure of technical facilities or of necessary transportation services; or any other exceptional or unpredictable event or condition beyond the parties’ control. Force Majeure in respect to a party’s supplier, manufacturer, or affiliates that makes performance of obligations (excluding payment and confidentiality obligations) impossible, unpredictable, or unsafe shall be considered Force Majeure in respect to the relevant party.

If a Force Majeure event occurs, performance of Haas’ obligations shall be suspended for the duration of the delay caused by the Force Majeure event, and the period of performance shall be automatically extended, without any penalty, for an equal period. Haas shall forthwith notify the customer of the nature and effect of such event, and both parties shall, where the same is practicable, use every reasonable endeavor to minimize such effect, and to comply with the respective obligation herein contained as nearly as may be in their original form.

Jurisdiction and Choice of Law. These Terms and Conditions, and all transactions made through this website, shall be governed by and construed in accordance with Belgian law, and no effect shall be given to any other choice-of-law or conflict-of-laws rules or provisions (Belgian, foreign, or international) that would cause the laws of any jurisdiction other than Belgian to be applicable. All disputes arising out of in connection with this Agreement shall be submitted to the exclusive jurisdiction of the Dutch speaking courts of Brussels (Belgium).

Haas Tooling Winner’s Circle
The Haas Tooling Winner’s Circle annual membership is non-refundable. Memberships last one year from the date of purchase. If you cancel the membership, you will have the remainder of the year to use your benefits before it ends. Membership will be automatically renewed one year from the date of purchase. If you do not want your membership to be renewed, you must cancel it in ‘My Account’ under the ‘Winner’s Circle’ section. All benefits of the membership only apply to Haas Tooling products. Haas Service products are excluded from Winner’s Circle discount but will receive shipping benefits. Haas Tooling Winner’s Circle discount cannot be combined with the education discount. Membership is based on your company location. If you have multiple locations for a single company you will need a membership for each location. All terms are subject to change at any time.  

Winner’s Circle Free Shipping on Orders Over €49. Free shipping is valid on orders of €49 or more (calculated using the standard retail price, before the discount is taken) shipped to a single address in the European Union. Online purchase is only available in the European Union. In all other countries, please contact your local HFO to order and for any applicable benefits. Shipping times may vary.
